DAMP HUB TERMS AND CONDITIONS

1. Introduction

1.1 These Terms and Conditions (“Terms”) apply to all services provided by Damp Hub at our website https://damphub.co.uk/ (“Site”) and govern the relationship between Damp Hub and clients (“you,” “your”).

1.2 By booking a service, visiting the Site, or purchasing a report, you confirm acceptance of these Terms. If you disagree, do not use our services.

2. Definitions

  • Client: The individual, agent, or entity commissioning services from Damp Hub.
  • Damp Survey: A non-invasive visual and diagnostic inspection of a property to identify damp-related issues.
  • Report: A written document summarising survey findings, including recommendations for remedial action.
  • Force Majeure: Events beyond reasonable control (e.g., natural disasters, government restrictions, pandemics).

3. Scope of Services

3.1 What We Do:

  • Visual inspection of internal and external walls, floors, ceilings, and adjacent structures.
  • Moisture content analysis using electronic hygrometers, thermal imaging, and salt testing.
  • Identification of rising damp, penetrating damp, condensation, and associated risks.
  • Delivery of a detailed PDF report within 5 working days of the survey.

3.2 What We Don’t Do:

  • Structural repairs, plastering, or chemical damp proofing.
  • Mould testing or remediation.
  • Guarantees for third-party contractors or previous damp treatments.

3.3 Access Requirements:

Clients must ensure unrestricted access to all areas of the property. Failure to do so may result in an incomplete survey and forfeiture of the booking fee.

4. Booking & Payment Terms

4.1 Booking:

  • Bookings are confirmed upon payment of a non-refundable deposit of £50 (deducted from the final invoice).
  • Full payment is due before the survey date or on the day of the survey.

4.2 Pricing:

  • Prices are listed on our website and include VAT at the prevailing rate.
  • Quotes are valid for 30 days from the date of issue.

4.3 Accepted Payments:

  • Credit/debit card (via secure Stripe gateway), BACS, or PayPal.
  • Late payments may incur a £15 administration fee or suspension of services.

4.4 Refunds:

  • Refunds are only issued for bookings cancelled 72 hours in advance.
  • Cancellations within 72 hours or non-attendance result in forfeiture of the deposit.

5. Cancellations & Rescheduling

5.1 Client-Requested Changes:

  • Rescheduling must be requested 48 hours before the survey date.
  • Failure to notify within this window results in a £30 rescheduling fee or deposit forfeiture.

5.2 Damp Hub Rescheduling:

  • We reserve the right to reschedule due to Force Majeure or unforeseen circumstances. Clients will be notified as soon as possible.

6. Limitation of Liability

6.1 Accuracy of Surveys:

  • Our surveys are non-invasive and based on visible evidence. Hidden or latent defects may remain undetected.
  • We are not liable for issues not identified during the survey unless caused by negligence.

6.2 Report Reliance:

  • The Report is for the exclusive use of the client and must not be shared with third parties without prior written consent.
  • We exclude all warranties, express or implied, except those mandated by law.

6.3 Maximum Liability:

  • Damp Hub’s liability for any claim arising from our services shall not exceed 200% of the fees paid.
  • We are not liable for indirect, consequential, or punitive damages.

7. Intellectual Property

  • The Report and all content on the Site are protected by copyright and intellectual property laws.
  • Clients may not reproduce, distribute, or commercially exploit the Report without prior written permission.

8. Data Protection

  • We comply with the UK General Data Protection Regulation (UK GDPR).
  • Personal data is collected to facilitate service delivery, marketing (opt-in), and legal compliance.
  • Data is stored securely and retained for 7 years unless otherwise required by law.

9. Governing Law & Jurisdiction

  • These Terms are governed by English law.
  • Disputes arising from these Terms or services shall be subject to the exclusive jurisdiction of the English courts.

10. General Provisions

  • Entire Agreement: These Terms supersede all prior agreements and represent the entire understanding between the parties.
  • Amendments: We reserve the right to update these Terms at any time. Changes are effective upon posting.
  • Severability: If any clause is deemed invalid, the remaining clauses remain in force.
